In these Terms, "MyDeckhand", "we", "us" and "our" refer to MyDeckhand Ltd. "you" and "your" refer to the person using the MyDeckhand service.

MyDeckhand is a digital platform designed to help boat owners and operators organise and manage information relating to their boats.

Features may include:

• Digital boat profiles
• Maintenance and repair records
• Service history
• Maintenance reminders
• Document storage
• Exportable service history
• Multiple boat management
• Virtual Deckhand / AI-assisted features
• Other boating-related tools and features introduced from time to time

The exact features available may depend on your subscription, account type or the version of the application you are using.

MyDeckhand is currently available on iPhone and iPad through the Apple App Store. An Android version is coming soon.

MyDeckhand is intended as an organisational and informational tool. It is not a replacement for qualified marine engineers, surveyors, mechanics, electricians, manufacturers, professional skippers or other appropriately qualified professionals.

You must be at least 18 years old to create an account or use MyDeckhand.

You agree to provide accurate and reasonably up-to-date information when creating your account.

You are responsible for:

• Keeping your login credentials secure
• Maintaining the confidentiality of your account
• Ensuring that information entered into your account is accurate
• All activity carried out through your account

You must notify us if you believe your account has been accessed without your permission.

We reserve the right to suspend or terminate accounts where we reasonably believe that an account has been created fraudulently, unlawfully or in breach of these Terms.

MyDeckhand is a live service that we continue to maintain and improve.

From time to time:

• We may add, remove or modify features.
• The service may experience errors or interruptions.
• Information, records or other data may be affected by technical problems.
• We may invite feedback from users to help improve the service.

We do not guarantee that any particular feature will remain available indefinitely.

MyDeckhand offers paid subscription plans.

Features and prices may change from time to time.

The price applicable to your subscription will be displayed to you before you purchase.

On iPhone and iPad, subscriptions are purchased through Apple's App Store in-app purchase system.

Unless otherwise stated, subscriptions are charged on a recurring basis until cancelled.

You may cancel your subscription in accordance with the cancellation process provided within the application or through the relevant payment provider.

Cancelling a subscription will normally prevent future renewal charges.

Unless applicable law requires otherwise, cancellation does not automatically entitle you to a refund for a billing period that has already started.

Where you have statutory consumer cancellation or refund rights, those rights are not affected by these Terms.

Nothing in these Terms is intended to remove or restrict any legal rights that you have as a consumer under applicable UK law.

Where applicable, you may have rights relating to digital content and digital services, including rights concerning satisfactory quality, fitness for purpose, conformity with description and remedies where a service does not meet applicable legal requirements.

Nothing in these Terms excludes liability that cannot legally be excluded or limited.

You may use MyDeckhand to store information relating to your boat, including:

• Maintenance records
• Repairs
• Service history
• Engine information
• Equipment information
• Documents
• Notes
• Dates and reminders
• Other information you choose to enter

You are responsible for ensuring that information you enter is accurate.

You should retain your own copies of important documents, certificates, service records and other critical information.

MyDeckhand should not be treated as the sole or definitive record of a boat's maintenance or service history.

MyDeckhand may provide maintenance suggestions, reminders, information or AI-generated assistance.

Such information is provided for general informational and organisational purposes only.

You remain responsible for determining whether any maintenance, repair or other action is appropriate for your particular boat.

You should consult an appropriately qualified professional where appropriate.

You should always follow the instructions and safety requirements provided by the relevant boat, engine, equipment or component manufacturer.

MyDeckhand does not guarantee that:

• A maintenance reminder is appropriate for your specific boat.
• A suggested maintenance interval is correct for your equipment.
• An AI-generated answer is accurate.
• A suggested repair or procedure is safe for your particular circumstances.
• Information provided by MyDeckhand is suitable for an emergency.
• Following information provided by MyDeckhand will prevent damage, injury or loss.

Do not rely solely on MyDeckhand for navigation, emergency situations, safety-critical decisions, mechanical repairs or other circumstances where professional or real-time information is required.

MyDeckhand may use artificial intelligence and third-party AI services to provide features such as the Virtual Deckhand.

AI-generated information may contain errors, omissions or inaccurate information.

AI responses should be treated as assistance rather than professional advice.

You should independently verify important information before acting upon it.

You remain responsible for decisions made using information provided through MyDeckhand.

We do not guarantee that AI-generated content will always be accurate, complete, current or appropriate for your specific boat.

MyDeckhand is not an emergency service.

The application should not be relied upon as a substitute for:

• Emergency services
• Coastguard services
• Official navigational information
• Charts
• Notices to Mariners
• Weather services
• Safety equipment
• Professional marine advice
• Qualified engineering or repair services

In an emergency, use the appropriate emergency and maritime services available to you.

You retain ownership of information, photographs, documents, notes and other content that you upload or enter into MyDeckhand.

You give MyDeckhand permission to process, store and display that content as reasonably necessary to provide the service to you.

You confirm that you have the necessary rights and permissions to upload or store any content you provide.

You must not upload content that:

• Infringes another person's intellectual property rights
• Is unlawful
• Contains malicious software
• Is fraudulent
• Is abusive or threatening
• Attempts to compromise or interfere with the service
• Breaches another person's privacy

You may request deletion of your MyDeckhand account.

When an account is deleted, associated account information and user content may be permanently deleted, subject to any information that we are legally required to retain.

Account deletion may be irreversible.

We recommend exporting or saving any important records before deleting your account.

We cannot guarantee that deleted information can be recovered.

MyDeckhand and its underlying technology are owned by or licensed to MyDeckhand Ltd.

This includes, where applicable:

• The MyDeckhand name
• MyDeckhand branding
• Logos
• Graphics
• Website design
• Application design
• Software
• Source code
• Databases and system architecture
• Written content
• Marketing materials
• Other intellectual property associated with the service

You may use MyDeckhand only for its intended purpose.

You must not copy, reproduce, modify, distribute, sell, reverse engineer or commercially exploit MyDeckhand or any part of it without our written permission, except where permitted by law.

You must not:

• Attempt to gain unauthorised access to MyDeckhand systems.
• Interfere with the operation of the application or website.
• Attempt to bypass security measures.
• Introduce viruses, malware or other harmful code.
• Use automated systems to abuse the service.
• Scrape or systematically copy MyDeckhand content without permission.
• Use MyDeckhand for unlawful purposes.
• Attempt to impersonate another person or organisation.

We may suspend or terminate accounts that breach these requirements.

We aim to provide a reliable service but cannot guarantee that MyDeckhand will always be available.

The service may occasionally be unavailable because of:

• Maintenance
• Updates
• Technical problems
• Hosting failures
• Internet or telecommunications failures
• Third-party service outages
• Security incidents
• Circumstances outside our reasonable control

We may modify, suspend or discontinue parts of the service where reasonably necessary.

MyDeckhand may rely on third-party services and technology providers.

These may include hosting, payment processing, authentication, email, analytics, artificial intelligence and other technology providers.

Third-party services may have their own terms and privacy policies.

We are not responsible for failures caused solely by third-party services outside our reasonable control.

To the fullest extent permitted by law, MyDeckhand Ltd will not be responsible for losses that are not reasonably foreseeable arising from your use of the service.

This may include, where legally permitted:

• Loss of data
• Loss of profits
• Loss of business
• Loss of opportunity
• Loss resulting from reliance on information provided by the service
• Damage resulting from maintenance or repair decisions made using MyDeckhand
• Indirect or consequential losses

Nothing in these Terms excludes or limits liability for:

• Death or personal injury caused by negligence
• Fraud or fraudulent misrepresentation
• Deliberate wrongdoing
• Any liability that cannot legally be excluded or limited

Nothing in these Terms affects your statutory consumer rights.

We may update or change MyDeckhand from time to time.

This may include:

• Adding features
• Removing features
• Changing the user interface
• Changing subscription plans
• Improving security
• Updating AI functionality
• Changing third-party services

Where a change materially affects a paid service, we will provide appropriate notice where required by law.

We may update these Terms from time to time.

The latest version will be made available through the MyDeckhand website or application.

Where appropriate, we will notify users of material changes.

Your continued use of MyDeckhand after updated Terms take effect means that you accept the updated Terms, subject to any rights you have under applicable law.

Your use of MyDeckhand is also subject to our Privacy Policy.

The Privacy Policy explains how we collect, use, store and protect personal information.

The Privacy Policy forms part of the overall terms governing your use of the service.

If you choose to subscribe to MyDeckhand marketing communications, we may send you information such as:

• Product updates
• New features
• Offers
• Promotions
• News
• Other MyDeckhand information

You can unsubscribe from marketing communications at any time using the unsubscribe mechanism included in the relevant communication.

Transactional communications, such as account verification, password resets and important service notices, may still be sent where necessary to operate your account.

These Terms are governed by the laws of England and Wales.

The courts of England and Wales will have jurisdiction over disputes, subject to any mandatory consumer rights that apply to you.

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be treated as removed or modified to the minimum extent necessary.

The remaining provisions will continue to apply.

These Terms, together with the MyDeckhand Privacy Policy and any other terms expressly referred to within them, form the agreement between you and MyDeckhand Ltd concerning your use of the service.
